High court restrains Amendment 2 until ruling

Washington Colorado cannot enforce its anti-gay-rights amendment as state courts decide whether it is legal, the U.S. Supreme Court ruled November 1.

Without comment, the court upheld a Denver judge's temporary injunction blocking Amendment 2 from taking effect until a court challenge is settled, and rejected the state of Colorado's appeal of the injunction.

The Supreme Court rejected the state's argument that Colorado court rulings set a too-high legal standard for judging whether the amendment violates gays' rights.

The Colorado Supreme Court upheld Denver District Judge Jeffrey Bayless' temporary ruling, saying the amendment "expressly fences out an independently identi-

fiable group" from equal participation in the political process.

"They, and they alone, must amend the state constitution in order to seek legislation which is beneficial to them," the state Supreme Court said. Thus, the case must be decided under a standard of strict legal scrutiny, the state court said.

The hearing in Bayless' court proceeded following the Colorado high court ruling. It ended October 22, but Bayless had not ruled at press time.

Colorado Attorney General Gale Norton said any decision by Bayless is likely to be appealed to the Colorado Supreme Court and then to the U.S. Supreme Court. ♡

Chevrei Tikva celebrates its tenth anniversary

Congregation Chevrei Tikva, Ohio's only synagogue with a specific outreach to lesbian and gay Jews, invites the community to share in its ten year anniversary celebration. A special Sabbath service is planned on Friday, November 19 at 8 pm. Anshe Chesed-Fairmount Temple at 23737 Fairmount Blvd. is hosting the service.

The featured speaker and scholar in residence will be Rabbi Yoel Kahn of Congregation Sha'ar Zahav, San Francisco. Rabbi Kahn has long been a leader in the gay and lesbian movement and was instrumental in the Central Conference of American Rabbis' (CCAR) decision to ordain openly gay and lesbian rabbis. Rabbi Kahn has spoken and written widely on sexuality, liturgy, spirituality and liberal decision making. He has addressed many Jewish and interfaith groups including conventions of the CCAR, the Union of American Hebrew Congregations (UAHC) and the American Academy of Religion.

Now a member of the UAHC and the World Congress of Gay and Lesbian Jewish Organizations, Chevrei Tikva was modestly created in the living room of one of its six founding members. From inception, the synagogue has been a safe space for Jews disenfranchised from their religion due to sexual orientation, providing a program of worship, social and educational events as well as a continued commitment to social action. For five years, Chevrei Tikva spear-

headed a fundraiser which gave over $30,000 to AIDS and women's community projects. The synagogue was also instrumental in the creation of the North Coast Men's Chorus. Chevrei Tikva has long been recognized

as a resource in the community, offering support to those living with HIV. In observance of the tenth anniversary, the congregation is holding an AIDS awareness pin sale through December. All of the proceeds will be donated to the AIDS Housing Council and the Cleveland Free Clinic.
